my mom's got an e90 with the sport package and it's only wearing 17s. i see the same car all the time with 16s and i know it has the sport package. what i failed to think about is is that it's a 325, not 330.

The OP is talking about a 06 330. The easiest ways to tell if its a sport:
-18in 162 wheels
-Circular Airbag (not diamond shaped)
-Sport seats (have thigh supports)

I'm coming from a 2004 E46 325Ci. Ran into an 06' 330i with 68k. Car runs smoothly, and the tires are brand new. I understand that they're supposed to come with RFCs, but the dealership put on new Continentals. They told me they'd take the price of new RFCs off the car since they messed up. As it sits, the car is 16,900. I am curious about it though?
I live in Kansas part of the year and in Arkansas during the coldest parts of the year. I had a 328is that could only be driven when the roads were clear and forget about driving on ice or unplowed roads if you want to get where you are going. I then bought a 2007 335i and did not get the sports package, hoping I could drive it a few more months out of the year. The 335i is a rocket that will put a Porsche in the dust and have a Vette eating fighting to keep up with you on curved roads. They are a complete blast to drive, although the the first off the line models had some pretty buggy software and it took 3 months to get a patch to just get the Satelite Radio to work. I had like number 17 off the line. I would forget about driving it on icy roads, or inclines packed with snow. If you only want to drive it a few months out of the year (even in flat Kansas) you will have alot of fun with it. If you want to drive one all year get the ix. For that reason I bought a 2009 535i with xDrive (they eliminated the x). It won't quite throw you back in the seat like 335i will when you stomp the gas, but you will get a fast, solid and sure footed vehicle that will go anywhere you want to go. I bought an X3 at the same time I got my 535 and the X3 with the sport package and has got stuck twice this year, one requiring a call to BMW Assist. Same place, same day, my 535 i xDrive drove through it like it was nothing.

You'll probably get better traction and a smoother ride without the run flats and they won't cost you near as much to replace so the dealer might be doing you a favor as long as the tires are approved by BMW. I would ask them for the exact reaon why it is or isn't a certified used BMW.

^ Pretty easy explanation for why it is not a CPO BMW. It appears it was a trade in or a used BMW bought at auction. If it isn't purchased at a BMW dealership (whether aquired through trade or auction) with less than 60k miles it is not eligible for the BMW CPO program. It certainly doesn't mean its not worthy, or of lower quality, simply means it is not eligible for the BMW CPO program due to the miles being greater than 60k.

$16-$17k sounds pretty realistic. For comparison, in October 2009 I bought a 2006 325i with 33k miles, premium, and cold weather for $20,400 at a BMW dealership. Sure its got less horsepower, but otherwise a pretty good comparison when you factor in the 30,000 less miles and the fact it has CPO coverage.

According to a buddy who buys at auction for an independent dealership, 2006 BMW e90s are currently going for $14-17k at auction, depending on mileage and options. There are a ton of them coming off their initial 39 month lease.

An extended warranty is going to set you back $2500+ at this point due to the high miles, so make sure the vehicle is solid. You may also want to check and see when the brakes were last serviced, as that is a $1500 job at a BMW dealership.

If all checks out, go ahead, buy, and enjoy!
